How to register a business name in Australia
If you plan to trade under a name that is not your own legal name or your company’s exact registered name, you need to register it as a business name. Here is everything you need to know.
What is a business name?
A business name (sometimes called a trading name) is the name under which you conduct business. If Sarah Jones runs a company called Sparkle Clean, ‘Sparkle Clean’ is her business name. Registering a business name does not create a new legal entity; it simply allows you to use that name in a way recognised by ASIC.
Do you need to register a business name?
You do NOT need to register a business name if you are a sole trader trading under your own full legal name. You DO need to register if you are a sole trader using any other name, a company trading under a name other than your exact registered company name, or a partnership using any name other than the full legal names of all partners.
Business name vs company name vs trademark
| Business name | Company name | Trademark |
Registered with | ASIC | ASIC | IP Australia |
Creates a legal entity? | No | Yes | No |
Protects your name? | Basic | Basic | Strong legal protection |
Cost | From $44/year | ASIC fee ~$597 | From $250 per class |
Duration | 1 or 3 years | Ongoing | 10 years (renewable) |
Registering a business name does not give you exclusive ownership. For stronger protection, particularly if you are investing in building a brand, consider trademarking through IP Australia.
How to check availability
Check availability using the eCompanies name check tool. Also run a Google search and check that a matching domain and social media handles are available.
How to register
1. Check the name is available using the eCompanies name check tool.
2. Confirm you have an ABN, which is required to register a business name
3. Choose to register for one year ($44) or three years ($102)
4. Complete the application with your ABN, business name, and contact details
5. Pay the registration fee and receive your certificate
Staying on top of renewal
Business name registrations must be renewed at the end of the period or they lapse. ASIC sends a reminder, but it is easy to miss. Set a calendar reminder, and keep your contact details updated in ASIC Connect, as missed renewal notices are one of the most common reasons business names lapse unintentionally.
